Intervention Protocol
FTI & Partners has a standardized intervention should be required to take the insolvent Administration powers of administration and disposition of the bankrupt, for example necessary opening or clearance phase Protocol
In case of intervention, and when required, FTI & Partners is in a position to implement specialised teams in the following areas, assuming their control:
- Interim management of the business
- Accounting/ Trade, Fiscal management
- Communication with financial and non-financial creditors
- Relationship with institutions such as the CNMV, judges, local governments
Interim Management Area
- Ability to deploy internal and external personnel with extensive managerial experience and management in areas of General Management and specialized management (logistics, industrial)
All this allows us to ensure in case of withdrawal of administrative powers, the most sensitive compliance processes, continue properly carried out by the Bankruptcy Administration
Trade/ Accounting Area:
- Interim staff
- Main protocol: review of monthly closings produced internally, preparing corporate accounts
Tax area:
- External consultant who draws up the settlements
- Main protocol: follow-up and revision of the periodic obligations in taxation matters, on the basis of the accounting data already revised, with close contact with the tax external consultants
Communication with the market area (CNMV- National Securities Market Commission in Spain- or equivalent organ)
- Interim staff
- Already obtained knowledge about obligations of communication by the Society
- Follow-up of the periodic reports to be prepared
- Communication of the relevant facts, when they happen
